General terms governing use of the website and the booking of stays
These Terms and Conditions (the “Terms”) govern access to and use of the website www.ricasolistays.com (the “Website”) and the booking of the stays and ancillary services offered under the Ricasoli Stays brand. By accessing the Website, submitting an enquiry or making a booking, the user declares that they have read, understood and accepted these Terms.
The contracting party is Ricasoli Group S.r.l., with registered office at Via Senato 29, 20121 Milan (MI), Italy, tax code and VAT no. 08638750961, R.E.A. MI - 2038959, share capital EUR 10,000.00 fully paid up, PEC ricasoliconsulting@legalmail.it, e-mail contact@ricasolistays.com.
Ricasoli Group S.r.l. is a single company operating on the market through several brands, each specialised by sector and none of which has separate legal personality: Ricasoli Travel (travel and mobility services), Ricasoli Realty (real estate services) and Ricasoli Stays (short lets and property management). Any reference to Ricasoli Stays in these Terms is to be understood as a reference to Ricasoli Group S.r.l., which assumes in its own name every obligation arising from the booking.
Ricasoli Stays offers selected short and medium-term lets and professional property management services on behalf of Owners, acting as the manager of the Property. Where a Property is booked through an OTA, the booking is governed by the OTA’s terms (including its cancellation and payment rules); these Terms and the Booking and Payment Terms apply to every direct booking made through the Website and to ancillary amounts processed through GuestyPay (for example tourist tax, extra services, ancillary charges).
As at the date of the last update of these Terms, the Website does not allow direct bookings to be completed online: the GuestyPay functionality is used to collect the tourist tax, extra services and any ancillary amounts due from guests whose bookings originate from OTAs. The provisions concerning direct bookings apply from the moment that functionality is enabled on the Website.
National Identification Code. Each Property holds the National Identification Code (CIN) provided for by Article 13-ter of Italian Decree-Law 145/2023, converted by Law 191/2023, which is shown on the Property page published on the Website and in every listing.
The Guest making the Booking must be at least 18 years old and have the legal capacity to enter into a binding contract. The person making the Booking is responsible for all members of their party, including minors, and warrants that they are authorised to act on their behalf, including for the purposes of communicating their personal data.
For direct bookings, the booking is concluded when Ricasoli Stays sends written confirmation and receives the payment due at the time of booking. The information published on the Website constitutes an invitation to treat and not an offer to the public, unless otherwise expressly stated.
Prices for stays are stated for each Property and are inclusive of VAT where applicable. Any ancillary costs (for example cleaning, tourist tax, extra services) are stated separately before the booking is completed.
All payments are governed by the Booking and Payment Terms, which form an integral part of these Terms.
Cancellations, changes and refunds are governed by the Cancellation and Refund Policy, which forms an integral part of these Terms.
The Guest undertakes to: occupy the Property within the maximum number of guests stated in the Booking; use the Property with due care, respect the neighbourhood and observe the house rules and any building regulations communicated to them; observe the policies on [parties and events], [smoking] and [pets] specified for each Property; provide a valid identity document for all guests, as set out in the following paragraph.
The Guest is responsible for any loss of or damage to the Property during the stay, beyond fair wear and tear.
The operator is required by law to report to the competent Police Headquarters (Questura), through the “Alloggiati Web” portal, the particulars of all persons accommodated, including minors, pursuant to Article 109 of the Italian Consolidated Public Security Act (Royal Decree 773/1931). The report is made within twenty-four hours of arrival and, for stays not exceeding twenty-four hours, within six hours of arrival.
To that end the Guest must present, for themselves and for each member of their party, a valid identity document. Refusal to provide such data prevents access to the Property and entitles Ricasoli Stays to terminate the Booking, the price remaining due in accordance with the Cancellation and Refund Policy.
The processing of the data so collected is described in the Privacy Policy published on the Website. Ricasoli Stays also complies with the obligations relating to the tourist tax and to tourism flow statistics laid down by applicable municipal and regional legislation.
Check-in is available from [hh:mm] and check-out is due by [hh:mm], unless otherwise agreed. Late check-out or early check-in may be granted subject to availability and may involve an additional charge.
Property management services for Owners are governed by a separate written management agreement and are not covered by these Terms.
To the maximum extent permitted by applicable law, Ricasoli Stays is not liable for indirect or consequential damage, nor for circumstances beyond its reasonable control. Nothing in these Terms excludes or limits liability which cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for wilful misconduct or gross negligence, or the mandatory rights of the Guest as a consumer.
Ricasoli Stays is not liable for failure to perform its obligations due to events beyond its reasonable control, including natural disasters, measures of the authorities, strikes, interruption of utilities or health emergencies.
All trade marks, logos, texts, images and other content of the Website belong to Ricasoli Group S.r.l. or to third parties who have licensed their use and may not be used without prior written consent.
Personal data are processed in accordance with the Privacy Policy published on the Website. Cookie preferences may be changed at any time through the Cookie preferences control located in the footer.
Complaints may be addressed to contact@ricasolistays.com; Ricasoli Stays undertakes to reply within [__] days. Pursuant to Article 141-sexies of the Italian Consumer Code, consumers resident in the European Union may use the alternative dispute resolution (ADR) mechanisms provided for by law. The European Online Dispute Resolution (ODR) platform ceased operating in 2025 and is therefore not referred to.
These Terms are drafted in Italian and made available also in the other languages in which the Website is published. In the event of any discrepancy, the Italian version prevails.
These Terms are governed by Italian law. The Court of Milan shall have jurisdiction over any dispute. Nothing in this clause deprives consumers of the protection afforded by the mandatory provisions of the law of the country of their habitual residence; in particular, consumers resident in Italy retain the jurisdiction of their place of residence or elected domicile (consumer’s forum) and consumers resident in another Member State of the European Union retain the mandatory protections available to them.
Ricasoli Stays reserves the right to amend these Terms. The applicable version is the one published on the Website at the time of the Booking.

Terms applicable to payments processed through the Website and GuestyPay
These Terms apply to payments processed through the Website and through GuestyPay in connection with a stay managed by Ricasoli Group S.r.l. under the Ricasoli Stays brand, including direct bookings (where enabled) and ancillary amounts relating to bookings made through an OTA.
Party collecting the payments. The party offering the services, issuing tax documents and collecting amounts through GuestyPay is Ricasoli Group S.r.l., whose identification details are set out in the Terms and Conditions. GuestyPay and Stripe are not parties to the accommodation contract: they act solely as providers of the technical payment services. On the receipt and on the card statement, the charge is attributable to Ricasoli Stays / Ricasoli Group S.r.l.
For direct bookings, the booking is confirmed when Ricasoli Stays sends written confirmation and receives the payment due at the time of booking. For OTA bookings, the booking is governed by the OTA’s confirmation; ancillary amounts are subsequently collected by Ricasoli Stays as set out below.
Payments are processed through GuestyPay, based on Stripe. By making a payment, the Guest also accepts the applicable terms of the payment service provider. Card and payment data are processed directly by the payment service provider in compliance with the PCI-DSS security standard; Ricasoli Stays neither collects nor stores full card details. The following are accepted: [Visa / Mastercard / American Express / other methods supported by GuestyPay].
The terms and notices of the payment service providers are available at https://www.guesty.com/privacy-policy/ and https://stripe.com/privacy. The payment service provider may carry out fraud and identity checks on transactions: where such checks are not successful, the payment may be declined and the booking not confirmed.
Depending on the booking, charges may include:
Amounts are charged [in euro / in the currency indicated at checkout]. Unless otherwise stated, prices are inclusive of VAT at the applicable rate. Any currency conversion costs or fees applied by the card issuer are borne by the Guest.
Unless otherwise stated for a specific Property or rate:
Non-refundable rates, where offered, are charged in full at the time of booking.
A refundable security deposit of [amount], or a pre-authorisation on the payment card, may be required [before / at] check-in to cover any damage or breach of the house rules. Any uncontested amount is released or refunded within [__] days of check-out, less any sums lawfully withheld for damage, missing items or extra services.
Where the municipality applies a tourist tax, Ricasoli Stays collects it from the Guest and pays it to the competent authority. The amount depends on the municipality, the applicable rate, the number of guests and nights and any applicable exemptions. The tourist tax is charged in addition to the price of the stay and is stated separately.
For bookings made through an OTA, the price of the stay is normally paid through the OTA in accordance with its payment terms. Ricasoli Stays may separately collect, through GuestyPay, the tourist tax, any extra services and ancillary charges, as well as any security deposit relating to the stay.
If a payment fails or is declined, Ricasoli Stays may suspend the booking and contact the Guest to arrange payment. Ricasoli Stays reserves the right to cancel a booking which remains unpaid at the due date, in accordance with the Cancellation and Refund Policy.
If the Guest believes that a payment is unauthorised or incorrect, they are invited to contact Ricasoli Stays first at contact@ricasolistays.com for a prompt resolution. Ricasoli Stays reserves the right to contest chargebacks relating to charges lawfully incurred (including no-shows, damage and agreed extra services).
A payment confirmation is issued for each transaction. An invoice may be issued on request, in accordance with Italian tax legislation.
In the rare event of a manifest pricing error, Ricasoli Stays will inform the Guest and offer the choice between confirming at the correct price or cancelling with a full refund of any amounts paid.
The data necessary to process payments are handled in accordance with the Privacy Policy published on the Website. Card details are entered directly with the payment service provider, which processes them in compliance with the PCI-DSS standard: Ricasoli Stays neither has access to nor stores the full card number.
The booking and payment management platform is provided by Guesty Inc., a US company, acting as processor; card payments are processed by Stripe Payments Europe, Ltd., established in Ireland. Any transfers of data outside the European Economic Area take place subject to the safeguards provided for by Articles 44 et seq. GDPR, as set out in the Privacy Policy.

Terms applicable to cancellations, changes and refunds
This policy applies to cancellations, changes and refunds relating to bookings and payments managed by Ricasoli Group S.r.l. under the Ricasoli Stays brand through the Website and GuestyPay. For bookings made through an OTA, the OTA’s cancellation and refund rules apply; this policy applies to direct bookings and to ancillary amounts collected by Ricasoli Stays.
Pursuant to Article 59(1)(n) of the Italian Consumer Code (Legislative Decree 206/2005) and Article 16(l) of Directive 2011/83/EU, the fourteen-day right of withdrawal does not apply to contracts for the provision of accommodation services for a specific date or period of performance. Cancellations are therefore governed by the terms set out below.
Unless a different policy is stated for a specific Property or rate at the time of booking:
Non-refundable rates, where offered, give rise to no refund once booked.
Should Ricasoli Stays need to cancel a confirmed booking before check-in (for example because the Property becomes unavailable), it will offer, where possible, comparable alternative accommodation or a full refund of the amounts paid for the cancelled stay. Liability for such cancellations is limited to those amounts, to the extent permitted by law.
Requests to change dates are subject to availability and to any difference in rate. Ricasoli Stays will endeavour to accommodate reasonable changes but cannot guarantee them.
No-shows and early departures give rise to no refund, save for any tourist tax not actually due (see paragraph 8) and any refundable security deposit.
Approved refunds are made through GuestyPay/Stripe to the same payment method used, normally within [__] days of confirmation. The processing times of the bank or card issuer may apply.
The tourist tax is due only for stays actually taken. In the event of cancellation, any tourist tax already collected and not due is refunded in full, irrespective of the cancellation terms applicable to the stay.
Where a stay cannot take place because of events beyond reasonable control (for example natural disasters, measures of the authorities, health emergencies), Ricasoli Stays will handle cancellations in good faith, refunding, where required by law, amounts which may not lawfully be withheld.
To cancel or change a booking, please contact contact@ricasolistays.com. The cancellation takes effect on the date on which the written request is received.
